Liability Waiver
Read this entire document carefully. By signing or by tapping "I Agree" you give up important legal rights, including the right to sue sk8camp and the Coach for certain injuries. Do not sign unless you understand it. If you have questions, consult your own attorney.
This Waiver applies to each lesson booked through the sk8camp platform ("Platform"). It must be signed by the adult skater for themselves, or by a parent or legal guardian on behalf of any minor under 18.
1. Parties
This Waiver is between:
- "sk8camp", meaning [LEGAL ENTITY NAME], its officers, directors, employees, agents, contractors, owners, and affiliates ("Releasees" together with Coaches as defined below);
- the "Coach", the independent contractor instructor selected through the Platform for a given lesson; and
- "You", the adult skater, or the parent/legal guardian of the minor skater identified below.
2. Nature of the Activity; Specific Risks
Skateboarding is an inherently dangerous activity. You understand and accept that risks include, but are not limited to:
- falls, trips, and impacts with the ground, ramps, rails, ledges, walls, fences, and other skatepark features;
- collisions with other skaters, bystanders, bicycles, scooters, animals, or vehicles;
- cuts, bruises, scrapes, sprains, strains, broken bones, dental injuries, joint dislocations, and torn ligaments;
- head injuries, including concussions and traumatic brain injury;
- spinal cord injuries, including paralysis;
- heat exhaustion, sunburn, and dehydration;
- death.
These risks exist even when the skater is supervised, wearing protective gear, and following instructions.
You also understand that public skateparks are uncontrolled environments. They may have rough surfaces, hazards, crowds, weather conditions, and other users whose behavior cannot be predicted or managed by sk8camp or the Coach.
3. Assumption of Risk
Knowing the risks described above, You voluntarily accept and assume all risks, known and unknown, of participating in skateboarding lessons booked through the Platform, including risks arising from equipment, terrain, weather, the conduct of the Coach, the conduct of other persons at the skatepark, and the skater's own conduct.
If You are signing on behalf of a minor skater, You confirm that You have explained these risks to the minor in a way they can understand, that the minor has voluntarily agreed to participate, and that You assume these risks on the minor's behalf to the maximum extent allowed by law.
4. Independent Contractor Acknowledgement
You acknowledge and agree that:
- Coaches are independent contractors, not employees or agents of sk8camp.
- sk8camp does not provide the instruction itself and does not control how Coaches teach.
- sk8camp does not own, operate, supervise, or inspect any skatepark.
- Coaches are individually responsible for their own conduct, instruction, and decisions during a lesson.
5. Safety Equipment and Coach Instructions
You agree that the skater will:
- wear a properly fitting helmet during every lesson, regardless of age;
- wear any additional protective gear the Coach requires (knee pads, elbow pads, wrist guards) for that lesson;
- follow the Coach's safety instructions and skatepark rules at all times;
- inform the Coach in advance of any medical condition, recent injury, or limitation that could affect safety.
6. Medical Authorization (for Minors)
If You are a parent or legal guardian of a minor skater, You authorize the Coach and sk8camp, in the event of an emergency where You cannot be reached, to:
- call 911 or other emergency services;
- transport the minor to a hospital or urgent-care facility, or accompany the minor in an ambulance;
- consent to first aid, emergency medical care, surgery, anesthesia, hospitalization, and other emergency treatment as recommended by a licensed health-care provider.
You agree to be financially responsible for all such medical care. You agree that sk8camp and the Coach are not liable for the cost of care or for outcomes of emergency treatment provided in good faith.

7. Release of Liability
To the maximum extent permitted by California law, You, on behalf of yourself, the minor skater (if any), and your respective heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue sk8camp, the Coach, and the other Releasees from any and all claims, demands, causes of action, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the skater's participation in a lesson booked through the Platform, including claims based on the ordinary negligence of sk8camp, the Coach, or any other Releasee.
This release does not apply to:
- gross negligence, recklessness, or intentional wrongdoing by sk8camp or the Coach;
- any liability that cannot be released under California law (see Civil Code ยง 1668);
- a minor's own personal-injury claim, to the extent California law does not permit a parent or guardian to release such a claim.
8. Indemnification
To the maximum extent permitted by California law, You agree to indemnify, defend, and hold harmless sk8camp and the Coach from and against any claim brought by or on behalf of the skater (or anyone claiming through the skater) for injury, death, or property damage arising from the skater's participation in a lesson, except for claims based on gross negligence, recklessness, or intentional wrongdoing.
9. Photo and Media Release (Opt-In)

I understand I will not be paid for this use. I can revoke this permission at any time by emailing [SUPPORT EMAIL]; sk8camp will stop future use but is not required to recall existing materials.

10. Severability
If any part of this Waiver is held invalid or unenforceable, the rest stays in effect. The remaining provisions will be enforced to the maximum extent permitted by law, and the unenforceable part will be reformed to the minimum extent necessary.
11. Governing Law and Venue
This Waiver is governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or related to this Waiver will be resolved per the dispute-resolution section of the sk8camp Terms of Service. Venue is Los Angeles County, California.
12. Entire Agreement
This Waiver, together with the sk8camp Terms of Service and Privacy Policy, is the entire agreement between You and sk8camp on its subject matter, and supersedes any prior agreement or understanding on the same topic.
Acknowledgement and Signature
I have read this Liability Waiver, Release, and Assumption of Risk in full. I understand it. I am at least 18 years old. I am signing voluntarily. If I am signing on behalf of a minor, I confirm I am the minor's parent or legal guardian and have the legal authority to bind the minor to this Waiver to the maximum extent permitted by California law.
